Special category data
Your optical prescription is information about your health, which is treated as special category data under the UK GDPR. We only process it so that we can accurately manufacture and dispense your glasses and comply with our obligations under optical regulations, and we protect it with additional safeguards. By providing your prescription when you order, you enable us to process it for these purposes.
3. Legal Bases for Processing
We process your personal data only where we have a lawful basis to do so. Depending on the circumstances, this will be one or more of the following:
-
Contract: where processing is necessary to perform a contract with you, for example fulfilling your order
-
Legal obligation: where we are required to process your data to comply with the law, for example tax and accounting rules or optical dispensing regulations
-
Consent: where you have given us your consent, for example to receive marketing as a new customer
-
Legitimate interests: where processing is necessary for our legitimate interests (or those of a third party), provided your rights do not override those interests — for example improving our site and services, and preventing fraud
Where we process prescription (health) data, we rely on the additional conditions permitted under Article 9 UK GDPR and the Data Protection Act 2018, including processing necessary for the provision of health care (optical dispensing) and, where applicable, your explicit consent.

process payments and manage your orders
-
verify your prescription and comply with optical regulations
-
communicate with you, including order confirmations and delivery updates

5. Sharing Your Personal Data
We may share your data with the following parties:
-
Service providers: such as IT and hosting providers, payment processors, couriers and delivery partners, and analytics providers

-
Companies in our group: meaning our subsidiaries, our ultimate holding company and its subsidiaries (as defined in section 1159 of the Companies Act 2006), only where necessary for operational purposes

-
Prospective buyers or sellers of our business: if we sell or buy any business or assets, we may disclose your personal data to the prospective seller or buyer; and if Direct Sight or substantially all of its assets are acquired by a third party, personal data held about our customers will be one of the transferred assets
We do not sell your personal data. Third-party service providers may only process your data on our instructions and are subject to strict contractual obligations, including duties of confidentiality and security.
6. International Transfers
Some of our service providers may process your data outside the UK or the European Economic Area (EEA), for example in connection with order fulfilment, payment processing or support services. Where your data is transferred outside the UK, we will ensure it receives an equivalent level of protection by using appropriate safeguards, such as UK adequacy regulations, the UK International Data Transfer Agreement, or the UK Addendum to the EU Standard Contractual Clauses.
7. Data Security
We implement appropriate technical and organisational measures to secure your data, including:
-
secure servers and encrypted connections (SSL/TLS)
-
encrypted payment processing through third-party providers
-
access controls, user authentication and staff confidentiality obligations
Where we have given you (or you have chosen) a password to access your account, you are responsible for keeping that password confidential. Please do not share it with anyone.
Unfortunately, the transmission of information via the internet is never completely secure. Although we do our best to protect your personal data, we cannot guarantee the security of data transmitted to our site, and any transmission is at your own risk. Once we have received your information, we use strict procedures and security features to try to prevent unauthorised access.

We retain your data only for as long as necessary to:
-
fulfil the purposes for which it was collected
-
comply with our legal, regulatory, tax and accounting obligations
-
resolve disputes and enforce our terms
Prescription data is retained for 7 years, in line with optical industry standards and guidance. When your data is no longer required, we securely delete or anonymise it.

-
Portability: request a machine-readable copy of the data you have provided to us, or ask us to transfer it to another provider

Withdraw consent: where we rely on your consent, withdraw that consent at any time without affecting the lawfulness of processing carried out before you withdrew it
We do not make decisions about you based solely on automated processing that produce legal or similarly significant effects.
You can exercise any of these rights at any time by contacting us at help@directsight.co.uk. You also have the right to lodge a complaint with the Information Commissioner's Office (ICO) at www.ico.org.uk or on 0303 123 1113, although we would appreciate the chance to address your concerns first.
